The Marine and Coastal Area Act 20112011 •
The passing of the Marine and Coastal Area (Takutai Moana) Act (“MCAA”) by Parliament on 24 March 2011 establishes a new regime for recognition of customary rights and title over the foreshore and seabed. A Court of Appeal finding that the Maori Land Court had jurisdiction to determine claims of customary ownership of the foreshore and seabed in Ngati Apa v Attorney-General [2003] 3 NZLR 643 led to the previous Government’s enactment of the Foreshore and Seabed Act 2004 (“FSA”). The FSA removed the ability of Maori to seek recognition of their customary or aboriginal title and vested beneficial ownership of the foreshore and seabed in the Crown, but allowed existing freehold title to remain. The perceived elimination of customary title under the FSA led to the creation of the Maori Party, and adverse reports by The Waitangi Tribunal (WAI 1071) and a United Nations Special Rapporteur (E/CN.4/2006/78/Add.3, 13 March 2006). Despite the criticism of the FSA it is worth noting that many of the provisions found under the MCAA are based on those found in the earlier enactment. This article provides some comparison of the MCAA with the FSA. The principal intention of the article, however, is to describe and comment on the key components of the new legislation, particularly those that effect decision making under the Resource Management Act 1991 (“RMA”).

Sydney Harbour: what we do and do not know about a highly diverse estuary2015 •
Sydney Harbour is a global hotspot for marine and estuarine diversity. Despite its social, economic and biological value, the available knowledge has not previously been reviewed or synthesised. We systematically reviewed the published literature and consulted experts to establish our current understanding of the Harbour’s natural systems, identify knowledge gaps, and compare Sydney Harbour to other major estuaries worldwide. Of the 110 studies in our review, 81 focussed on ecology or biology, six on the chemistry, 10 on geology and 11 on oceanography. Subtidal rocky reef habitats were the most studied, with a focus on habitat forming macroalgae. In total 586 fish species have been recorded from the Harbour, which is high relative to other major estuaries worldwide. Executive Summary: Wolfville Harbour is a part of the Minas Basin, which is known to be a highly productive ecosystem. One would often visit Waterfront Park at the Wolfville Harbour and wonder what the sources were of the effluent being discharged into the Harbour. Questions rose as to what the effects were on populations such as Spartina alterniflora and Corophium volutator, which provide ecosystem services that benefit animals and humans. After doing some research, one would learn that the effluent is discharged into the Harbour untreated and unmonitored. This was alarming since stormwater effluents are derived from rainfall and snowmelt – essentially surface runoff, which can contain a myriad of pollutants, including debris and chemicals that can be detrimental to ecosystems. A major component of stormwater effluent is road salt. As a result of this, in addition to available instrumentation for data collection, one focused this study on the effects of salinity. Spartina alterniflora and Corophium volutator can both tolerate wide ranges of salinity, however there are limits. Despite these limits, it was determined through research and review of literature that the volume of input of stormwater effluent in the Harbour is negligible in terms of its salinity. This is because the Harbour naturally experiences wide variations in salinity due to freshwater input from rivers and strong tidal influences from the Bay of Fundy that efficiently mix the water. However, it is recommended that further research be conducted to study effects of climate change on tidal influence, as well as concentrations of chemicals in stormwater effluent and their potential impact on the ecology in the Wolfville Harbour.
